Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Eleganza website, mobile applications, and related services (collectively, the "Platform") operated by Eleganza Fashion Private Limited ("Eleganza", "we", "us").

By accessing or using the Platform, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. If you are placing an order on behalf of another person, you confirm you have authority to do so.

To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at support@eleganza.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or provide false information.

We strive to display product images, colours, and descriptions as accurately as possible. However, due to variations in screen settings and fabric batches, actual products may differ slightly from images shown. Product availability is subject to change without notice.

All prices are listed in Indian Rupees (INR) and include applicable GST unless stated otherwise. We reserve the right to modify prices, offers, and promotions at any time. The price charged will be the price displayed at the time of order confirmation.

In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.

Placing an order constitutes an offer to purchase. Order confirmation via email or SMS constitutes our acceptance. We may refuse or cancel orders at our discretion, including for suspected fraud, stock unavailability, or pricing errors.

Accepted payment methods include UPI, credit/debit cards, net banking, and Cash on Delivery (where available). Payment must be received or confirmed before dispatch for prepaid orders.

For Cash on Delivery orders, payment is due upon delivery. Refusal to accept delivery may result in restrictions on future COD orders.

We ship across India through trusted logistics partners. Standard delivery timelines are 4–7 business days for metro cities and 7–10 business days for other locations, subject to courier availability and force majeure events.

Free shipping is available on orders above the threshold displayed on our Shipping & Returns page. You will receive tracking information once your order is dispatched. Risk of loss passes to you upon delivery to the address provided.

We are not liable for delays caused by incorrect addresses, recipient unavailability, customs (if applicable), natural disasters, or other events beyond our reasonable control.

Our return and refund policy is detailed in our Refund Policy. Returns are accepted within 7 days of delivery for unworn items with original tags. Sale items, innerwear, and customised products are non-returnable unless defective.

Refunds are processed to the original payment method within 5–7 business days after the returned item is received and inspected. COD orders are refunded via bank transfer or store credit.

All content on the Platform — including logos, product photography, text, graphics, and software — is owned by Eleganza or its licensors and protected under the Copyright Act, 1957, Trade Marks Act, 1999, and other applicable laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

You agree not to:

• Use the Platform for any unlawful purpose
• Submit false, misleading, or fraudulent orders or reviews
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use automated tools to scrape, crawl, or harvest data from the Platform
• Interfere with the proper functioning of the Platform

To the maximum extent permitted by law, Eleganza shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the relevant order.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. Before initiating legal proceedings, we encourage you to contact our customer support team to resolve the matter amicably.
